CHITOTELA’S FIRM SUED OVER K60, 000 BALANCE

TOURISM Minister Ronald Chitotela and his company have been sued for failure pay over K60, 000 for the purchase of a Scania Rigid truck since April this year.

Evans Sitali and Musa Saidi dragged Mr Chitotela, RKC Tours and Guide Limited and Petronella Mutale, the administra­tive officer in r Chitotela s company to the Lusaka High Court.

he plaintiffs want payment of K100, 000 as damages for loss of business and breach of contract.

hey also want an order for immediate payment of , as balance owed by r Chitotela and the others for the sale of the motor vehicle.

he plaintiffs want nterest from pril to date of payment at current ban lending rate and any other reliefs that the court may deem fit.

ccording to a statement of claim r itali and r aidi stated that they were sellers of the motor vehicle registrati­on number to C ours and Guide Limited through Mr Chitotela and Ms Mutale at an agreed price of , on pril this year.

hey stated that they received a down payment of , and that there was a balance of , which the defendants promised to pay in two wee s which is pril from the date of transactio­n.

he plaintiffs claimed that they had a condition of sale to the effect that change of ownership would be effected after the balance of , was paid in full.

hey claimed that despite several reminders on Mr Chitotela and the others to settle the balance, they had refused or neglected to do so.

he plaintiffs have, made several reminders through phone and message calls to the defendants to have the said balance paid and the defendants have refused or neglected to pay the said balance of , , read part of the claim.

he plaintiffs, however, claimed that as a result of the failure to pay the balance from pril this year to date, they have suffered serious loss of business and that they would have made , profit if they in ected the same money in their business.
