NORRISTOWN » A Philadelphia man admitted to raping an intoxicated female friend while she was a passenger in his vehicle in Horsham and now he’s headed to state prison.

Joshua Luke Nathaniel Plentie, 22, of the 1100 block of Elbridge Street, was sentenced in Montgomery County Court to 2 to 5 years in a state correctional facility after he pleaded guilty to felony charges of rape and aggravated indecent assault in connection with a September 2020 incident in the area of the 200 block of Easton Road in Horsham.

Judge Thomas P. Rogers, who accepted a plea agreement in the case, also ordered Plentie to complete seven years’ probation following parole, meaning Plentie will be under court supervision for 12 years.

Plentie also faces a lifetime requirement to report his address to state police in order to comply with Pennsylvania’s Sexual Offender Registration and Notification Act.

Plentie must undergo a psychosexual evaluation and comply with all recommendations for treatment.

The judge said Plentie is to have no contact with the victim. Plentie also was ordered to stay away from the Days Inn along Easton Road in Horsham, where the victim was staying at the time of the sexual assault.

By pleading guilty to the rape charge, Plentie, who was 20 years old at the time of the incident, admitted that he engaged in sexual intercourse with a woman who was unconscious or when he knew that she was unaware that sexual intercourse was occurring.

The investigation began on Sept. 18, 2020, when Horsham Township police responded to Abington Hospital where a female was being treated after reporting she had been sexually assaulted while in Horsham.

The woman, who had been staying at the Days Inn in the 200 block of Easton Road, told detectives that on Sept. 17 she called Plentie, a friend, and asked to borrow money for food and Plentie took her to a nearby fast food restaurant, according to a criminal complaint filed by Horsham Detective Kimberly Ngo.

The woman told detectives she and Plentie sat in his vehicle eating the food and drinking alcohol and that she believes she later lost consciousness, according to the arrest affidavit. While Plentie was parked in an area neighborhood, he began fondling the woman and having sexual contact with her, the woman told detectives.

“(The victim) stated she could not form sentences and could only mumble but does remember telling Plentie, ‘No,’” Ngo alleged in the arrest affidavit.

After Plentie took the woman back to the Days Inn, she told a friend that Plentie had raped her and that friend transported her to the hospital.

When detectives interviewed Plentie about the woman’s claim, Plentie said the woman was heavily intoxicated and he admitted that he did not have consent to fondle the woman, according to the criminal complaint.

Plentie explained he could not remember everything, claiming that since he was a child if something upsets his “neutral mindset” he suppresses it, according to the criminal complaint.

When asked if he raped the woman, Plentie allegedly replied, “I have no memory of it. But I think, yes. But that is not a memory I want to remember,” according to court papers. Plentie allegedly stated that everything pointed to his raping the woman and that he “raped the one person he truly cares about.”

Other charges of involuntary deviate sexual intercourse, sexual assault, indecent assault and harassment were dismissed against Plentie as part of the plea agreement.
