I want my money back – my Bentley can’t tow my caravan

‘It doesn’t do what we wanted’

A MOTORIST wants a car dealer to hand back the £141,758 she spent on a Bentley SUV which she says is unfit to tow a caravan.

Elizabeth Deas has raised an action against Park’s of Hamilton (Townhead Garage) Ltd in relation to her Bentley Bentayga.

The Sheriff Appeal Court in Edinburgh heard that Mrs Deas, of Airdrie, Lanarkshir­e, purchased the vehicle, which she wanted to use to tow a caravan, in February 2020.

Her lawyers claim that staff failed to fit a towbar at the correct height, making it impossible to use the car for this purpose.

The story emerged after lawyers for Parks went to the Sheriff Appeal Court to challenge an earlier decision made by a sheriff last August, that allowed Mrs Deas to bring the action.

In a written judgment issued yesterday, appeal sheriff Aisha Anwar refused to overturn the earlier decision.

Sheriff Principal Anwar concluded that the hearing could proceed in a sheriff court.

She wrote: ‘The respondent has purchased a vehicle which she claims is not fit for purpose.

‘The tow bar has a height in operation of 500mm. She claims that the vehicle cannot be used to tow a caravan, the height of the tow bar being too high for that purpose.

‘She seeks to reject the vehicle and claims repayment of the purchase price and other losses. Her claim is a straightfo­rward consumer claim, the likes of which are commonplac­e in the sheriff courts.

Last night, Mrs Deas said: ‘It’s been going on for two years now, I still have the car and used the car every day. It is a lovely car, there is no doubt in that. It just doesn’t do what we wanted it to do, and they told us it would.’
