Child rape talk ‘just a fantasy’

- DAVID MEIKLE

A FORMER councillor was acting out a “fantasy” when he told an undercover policewoman he would meet her and rape a child, a court has heard.

David Fagan, 53, took part in online chats with the officer and spoke about sexually abusing two girls aged 12 and 14.

But it has been claimed Fagan never planned to carry out the acts.

Fagan, of Airdrie, is on trial at the town’s sheriff court where he denies sending messages in relation to incest, sexual abuse of children and the rape of a child between May and August 2016.

He also denies conspiring to meet a 14-year-old girl for sex while another girl, aged 12, was present.

A jury heard Fagan was talking to an undercover 45-year-old female detective constable who was working in a secret location.

Defence advocate Allan Macleod said to the officer: “These conversations were simply you encouraging fantasy with the accused. At no point did he ever have any intention of carrying these acts out.”

Mr Macleod said police did not find any evidence of child pornography on Fagan’s computer following his arrest in September 2016.

The court later heard Fagan had messaged a male undercover police officer in May 2016 via an explicit site and discussed sexually abusing a girl but stopped when he was told she was 10.

The trial continues.
