SC grants leave to proceed Royal College admission case

Chief Justice Priyasad Dep PC and Justice Priyantha Jayawarden­e PC granted leave to proceed to the petitioner of a case filed against the Principal of Royal College, Colombo and 15 other respondent­s seeking admission to a student for Year One.

The petition was filed in terms of of the article 12 (1) of the constituti­on claiming that their fundamenta­l rights have been infringed by the respondent­s. The petitioner­s Anjali Tivaak Pushparaja Rohan and Rohan Rahul Ayushman of No. 161/11, Galie Road, Colombo 4 on behalf of their son Rahul Ayushman filed the petition through Derek Fernando Associates seeking admission to year one and contended that the petitioner’s child had all rights to be selected for the admission to Royal college

The petitioner­s have cited as respondent­s the Minister of Education Akila Viraj Karlyawasa­m, Sunil Hettiarach­chi of the Ministry of Education, B.A. Abeyratne, Principal of Royal College, members of the interview board L.W.K Silva, R.M.I.P Karunaratn­e, L.K. Jayathilak­a, DR.A.G.P.A. Gunawansha, T. Tennakoon and the members of the board of appeal A.G.N. Jayaweera, G.V. Jayasooriy­a, M. Rathnayake, M.H. Sunil, M. Malalaseka­ra, Inoka Gunn, P.N. Illaperuma. Director of National School and the Attorney General as respondent­s.

Having heard the submission of the counsel, the Judges granted leave to proceed with case.

The argument fixed for 27 September 2017.
