A 13-year-old girl filed a criminal complaint against the live-in partner of her mother who allegedly abused her.

Prosecutor III Ruso Zaragoza of the Cebu City Prosecutor’s Office found sufficient evidence to hold the accused for trial.

“As such, there exists strong evidence for the existence of probable cause to indict respondent of child abuse under Section 10, Article VI of Republic Act 7610 since he brought or accompany the child complainant to a lodge or private place of which is he more than 10 years older and they are not related as provided by law,” the resolution read.

The FREEMAN is withholding the names of the parties due to the sensitivity of the case.

The minor alleged that around 10 a.m. on August 16, 2014, she was told by her mother to get the latter’s salary at T. Padilla Street, Cebu City and to proceed to Barangay Mambaling to pay for the amortization of their motorcycle.

The minor narrated that in order to complete her chores, she rode a motorcycle driven by the accused.

An hour after she was done with her errands, she rode the motorcycle again thinking that she and the accused would be going straight home.

To her surprise, they reached Colon Street, disembarked from the motorcycle and walked towards TMS Lodge.

When the minor asked the accused why they were there, the accused told her that they would just wait for a certain “Manoy.”

The accused allegedly then pulled her towards the lobby of the lodge, telling her to go upstairs.

The accused went to room 302 and told the minor to follow but she refused and managed to escape by running downstairs.

The minor then reported the incident to her mother.

The accused remains at large and Zaragoza recommended P120,000 bail for his temporary liberty.
