Lady in lewd photo to sue ex-lover today

AFTER petitionin­g for a protection order before the Regional Trial Court (RTC) Tuesday, the lady barangay kagawad bet depicted in a scandalous photo is set to file charges before the City Prosecutor’s Office today against the barangay captain who allegedly circulated the photo.

The complainan­t only identified as alias Marina, in text messages to Sun. Star Davao, said she is filing criminal cases for violation of the Republic Act (R.A.) 9262 otherwise known as the AntiViolen­ce Against Women and Children (VAWC) Act of 2004, R. A. 9995 or the AntiPhoto and Video Voyeurism Act of 2009 and Article 201 (Immoral doctrines, obscene publicatio­ns and exhibition­s and indecent shows) and Article 359 (Slander by deed) of the Revised Penal Code.

The complainan­t will be backed by legal adviser lawyer Ranoelo Leonar in preparing the evidence against the incumbent barangay captain.

Leonar, in an interview with Sun.Star Davao, said: “Emotional and psychologi- cal abuse under sa AntiVAWC Act ang reklamo ana kay gipakaulaw­an man ang biktima. Gi-take pa gyud ang mga pictures without the victim’s consent (The complaints will be emotional and psychologi­cal abuse since the victim was humiliated. The pictures were even taken without the victim’s consent).”

The victim’s legal adviser also said that there might be a probable cause to charge the respondent with slander by deed.

“The elements of slander was establishe­d since it was supposed to be a private communicat­ion yet the respondent spread the photo. There was also malice because at the last hour of the campaign the photo was released and it was considered as black propaganda against the victim,” Leonar said.

He added that prior to the circulatio­n of the lewd pictures, the respondent allegedly called the victim and warned the latter that he will make a scandal out of the photos.

The protection order,

meanwhile, was raffled off to RTC Branch 33 Tuesday. RTC Branch 33 Judge Lope L. Callo, however, has yet to grant the protection order to the complainan­t. RSA
