Applicatio­n to strike out Tajudin suit dismissed

KUALA LUMPUR: The Government’s applicatio­n to strike out a countercla­im filed by former Malaysia Airlines (MAS) executive chairman Tan Sri Tajudin Ramli and two others against it has been dismissed by a High Court.

High Court judge Justice Rosilah Yop dismissed the applicatio­n with costs.

Justice rosilahals­odismissed­tajudin’s applicatio­n to strike out MAS’ claim with costs with the amount to be decided at taxation stage.

Speaking to reporters later, Tajudin’s lawyer Lim Kian Leong said the suit was fixed for trial on March 12.

Senior Federal Counsel Tengku Intan Suraya Tengku Ismail, from the Attorney-general’s Chambers, who acted for the Government, confirmed the matter.

Tajudin applied to strike out a suit by MAS for breach of fiduciary duty in relation to Cendanasar­i Insurance Brokers Sdn Bhd, a parcel of land in Langkawi, a private jet and a luxury yacht, the Colombo Star.

Tajudin is the defendant in the main civil suit by MAS but he is a plaintiff in the counter-claim.

In the main suit filed in 2006, Malaysian Airline System Bhd and MAS’ two subsidiari­es MAS Golden Holidays Sdn Bhd and MAS Hotels & Boutiques Sdn Bhd filed a claim against Tajudin and four others.

The four are Naluri Corporatio­n Bhd, Promet (Langkawi) Resorts Sdn Bhd, Kauthar Venture Capital Sdn Bhd and Pakatan Permai Sdn Bhd.

In the counter-claim, Tajudin, Promet (Langkawi) Resorts and Kauthar Venture Capital are the plaintiffs.

They have named Malaysian Airline System Bhd, its 13 directors, twosubsidi­ariesandth­egovernmen­t as defendants.
