Children of couple killed in Duta-Ulu Kelang Expressway crash to testify in their custody case

KUALA LUMPUR: The Syariah High Court here yesterday ordered the two children of a couple who was killed in an accident on the Duta-Ulu Kelang Expressway in May 2015 to be brought to court to testify in their custody case.

They are Nur Firuza Amira Fairuz Nizam, 10, and sevenyear-old Nur Firuza Aqila Fairuz Nizam, both currently staying with their aunt, Yusnidah Hussain, who was given temporary custody of the two girls since Aug 11, 2015.

The court set April 2 for the two children to appear before Syarie judge Muhamad Abdul Karim Wahab to testify on the matter, whether they want to stay with their grandmothe­r, Wirda Syamsuddin, 55, or Yusnidah, 50.

Syarie lawyer Mahyuddin Md Zahari, representi­ng Yusnidah, said the court would decide on the same day on the permanent custody applicatio­n of the two girls by Yusnidah, 50.

He told reporters this after proceeding of the case before Syariah registrar Mustaffa Amri Yussuf here, which was also attended by syarie lawyer Yusfa Hanis Yusoff, who represente­d Wirda.

Yusnidah filed the applicatio­n for permanent custody of the two children on June 2, 2015 in accordance with Section 81 of the Islamic Family Law (Federal Territory) Act 1984, She named Wirda as defendant.

The two girls not only lost their parents, but also their six-month old baby sister, Nur Firuza Annisa, in the crash, which occurred as they family was returning home to Taman Muda, Batu Caves near here. — Bernama
