Man gets 13 years for causing death over payment of Montoku

KOTA KINABALU: A 27year- old man was sentenced to 13 years in jail for causing the death of another man over payment of Montoku (alcoholic drink).

Sessions Court judge Noor Hafizah Mohd Salim imposed the sentence on Jexssion Gunsalam after he admitted to the charge yesterday.

Jexssion had committed culpable homicide not amounting to the murder a Peternius Kisong, 44, at a stall by the roadside of Kampung Rangalau Jalan Tamparuli in Kiulu, Tuaran at 9pm on January 3, 2013.

The offence is charged under Section 304(a) of the Penal Code which provides for a jail term of up to 30 years and fine, upon conviction.

In mitigation, the accused, who was not represente­d, prayed for a lenient sentence as he wanted to look after his parents.

Deputy public prosecutor Dinesh Raja replied that the offence is a serious offence and urged for a deterrent sentence to be imposed against the accused. The court also ordered for the jail term to start from yesterday.

The facts of the case stated that, Jexssion, who had a Montoku drinking session with the deceased in the afternoon and went back to the stall at 9pm.

At the stall, he saw the deceased asleep, took a stone nearby and hit the deceased¡¦s head with it.

Then, he threw the stone away, picked up a wood and hit the deceased’s head again several times.

The accused put the deceased, who was unconsciou­s, in a drain behind the stall.

An investigat­ion revealed that Jexssion was angry with the deceased who often drank Montoku with him but refused to come up with his share of the payment.
