Woman wants to withdraw report against brother

KOTA KINABALU: A woman, who made a report against her brother for causing hurt to her, attempted to withdraw her police report against him during hearing of her case in the Magistrate’s Court here yesterday, citing that she felt pity for him in view of his children, who pined for his presence.

The woman testified in court before magistrate Afiq Agoes that the children of her brother, Ag Mohd Nazree Yusop, 30, had been crying and asking for their father.

However, prosecutin­g officer Inspector Lim Swee Beng raised the question as to what would happen if the accused were to punch her again?

In response, the woman said, “It is up to him.”

The prosecutio­n then tried to reason that her pity on her brother’s kids would be meaningles­s if the accused were to punch her again after she withdraws her police report. The woman gave the same response and explained that she was not forced by the accused to make the decision.

The prosecutio­n subsequent­ly applied for another hearing date pending instructio­n from the deputy public prosecutor’s office on the case.

Lim submitted that based on his previous experience, such reason given on the victim’s feeling of pity for the kids was not a strong one to not proceed with the case.

The accused was alleged to have caused hurt to his 28-year-old sister at the compound of an unnumbered house at Kampung Karambunai in Manggatal at 10 am on March 28.

Counsel Sylvester Kuan for the accused in applying for bail, submitted that he is currently unemployed and taking care of his four kids and prayed for a lower bail be given.

The court set May 7 for re-mention of the case and released the accused on RM2,000 bail with two local sureties. The magistrate also ordered the accused not to contact the victim, pending disposal of the case.
