ISA SAMAD, EMIR TOLD TO FILE DEFENCE

The two have to file the statement by Feb 4, says counsel

FORMER FGV Holdings Bhd chairman Tan Sri Mohd Isa Abdul Samad and former group president and chief executive officer Datuk Mohd Emir Mavani Abdullah were ordered by the High Court to file their statement of defence in the suit against them by the company.

The suit is in relation to the acquisitio­n of two luxury condominiu­m units at Troika at 19, Persiaran KLCC, here at prices significan­tly above market value.

Counsel Lavinia Kumaraendr­an, who represente­d Isa, said the two defendants had to file the statement by Feb 4.

“Further case management has been fixed on Jan 23,” she said after the matter came up before High Court deputy registrar Farah Shuhada Ramli.

FGV, as the plaintiff, had, through a Bursa Malaysia filing on Nov 30, stated that the acquisitio­ns were also made without proper due diligence, wrongful and/or unauthoris­ed use and possession of the Troika units by both defendants.

The suit also pertains to the acquisitio­n of a number of cars and their misuse by Emir, as well as misuse of petrol benefits.

FGV seeks damages against the defendants, including RM4.54 million for the total acquisitio­n, use and possession­s of the Troika units, RM3.14 million in relation to the pool of cars and RM10.84 million for petrol benefits against Emir.

In addition, the company is seeking interest at the rate of five per cent per annum on damages awarded starting from the date of the filing of the suit until the date of full and final settlement.
