Suspended DIS legal director refusing with Khama, Kgosi docket

Pulane Kgoadi - one of the suspended o cers of the Directorat­e of Intelligen­ce and Security ( DIS) who is the director legal - is accused of refusing to hand over documents relating to investigat­ions against former President Ian Khama and former DIS boss, Isaac Kgosi. is is according to a letter of suspension authored by DIS Director General Peter Magosi dated 24th April 2024. In the suspension letter seen by this publicatio­n, Magosi indicates that there is also a matter that remains outstandin­g arising from the instructio­n given to Kgoadi to retrieve and to hand over to another o cer designated and assigned by Magosi in Kgoadi’s place and “stead, all files, exhibits, documents and all evidentiar­y material, all the informatio­n relating to on- going investigat­ion concerning the former President Lieutenant- General Ian Khama Seretse Khama and Isaac Seabelo Kgosi.” Magosi recorded that this is a prior instructio­n which was given to Kgoadi by him several weeks ago and to date, it has not been complied with.

“I must view your conduct as an act of gross insubordin­ation deliberate­ly calculated to undermine the authority of the o ce of the Director General. “Having regard to the gravity of this matter, you are hereby directed with immediate effect to carry out the instructio­n in question and to report in person to the Chief of Sta of the Directorat­e before 5.00 pm today and to deliver all the outstandin­g les and all other material and documents, pertaining to the on- going investigat­ion referred to in paragraph 9 above,” Magosi said in the letter.

He stated that there is also a matter that remains outstandin­g arising from Kgoadi’s refusal to hand over her mobile phone( s) for forensic examinatio­n to the team of DIS / Botswana Police, investigat­ing employment- related matters and in addition, whether there are criminal o ences or crimes which might have been committed by her alone and/ or with others as suspects in the course and scope of her employment or otherwise. According to Magosi he is made to believe that all of Kgoadi’s other colleagues have duly complied with the instructio­n and/ or request from law enforcemen­t o cers to hand over their mobile phones. He said it therefore appears that Kgoadi is the only one who refused to comply.

He added that, “having regard to the gravity of this matter, you are hereby directed with immediate e ect to hand over your mobile phone( s) to the Chief of Sta of the Directorat­e before 5.00 pm today, pertaining to the on- going investigat­ions referred to in paragraphs 9 and 10 above. “Failure to comply may result in your immediate arrest and detention and will be the subject of disciplina­ry charges of gross misconduct against you which may lead to terminatio­n of your employment.”

Kgoadi has been directed to surrender with immediate effect, her Certi cate of Identity, service weapon, arms and ammunition, the motor vehicle, mobile phones, sim cards, laptop, iPad, computers, credit cards, keys, access cards, security passes, any other work- related gadget, documents, manuals, and all other material and records in “your possession in relation to your employment, or in respect of any position or o ce or other capacity, duties and responsibi­lities in which you have been serving as a signatory, representa­tive or trustee or other position on behalf of the Directorat­e and/ or the Government of Botswana as the employer, in accordance with the disciplina­ry procedures and the provisions of any applicable written laws, including the Intelligen­ce and Security Service Act [ Cap. 23: 03]”.

Sources within the intelligen­ce have claimed that Kgoadi and Setlhabi chanced upon damning informatio­n against powerful individual­s including their boss. It is alleged that this troubled their boss who then came with a claim that the duo is working with former President Khama and that Kgoadi has received about P4.1 million. Kgoadi, Paul Setlhabi and Kuda Malikongwa who are serving suspension­s, have taken the Directorat­e and Magosi together with Botswana Police to court seeking an interim order that the DIS and Police be interdicte­d from arresting, detaining, searching their motor vehicles and putting them under surveillan­ce. e case will be heard on the 27th of May 2024 before justice Boipuso Makhwe.
