European sues bank for compensati­on in Abu Dhabi

ABU DHABI: A European national filed a labour lawsuit against a bank, demanding that the bank pay him Dhs501,000 in compensati­on for the material and moral damages he incurred, with an interest of 12% from the date of filing the lawsuit until full payment, in addition to the fees and expenses of the lawsuit and the lawyer’s fees.

In his lawsuit, the appellant indicated that the bank offered him a job as a banking services team leader, in return for a monthly salary of Dhs65,500 provided that he would start work ater a month. He added that he agreed to the offer 4 days later, and started to complete his travel procedures from his country of origin, refusing to All offers received from other parties.

The appellant affirmed that the actual working relationsh­ip with the bank started a month ater receiving the job offer, and he repeatedly asked the bank to complete his residency procedures in the UAE, but he received the bank’s apology for not being able to employ him.

The Abu Dhabi Labour Court of First Instance rejected the lawsuit for not following the legal ways and exempted the appellant from the lawsuit expenses.

He then appealed the ruling, claiming comprehens­ive compensati­on for the material and moral damages he incurred, in addition to the legal interest, and obligating the bank to pay the fees and expenses of the lawsuit and the lawyer’s fees.

The Abu Dhabi Appellate Court ruled that the appellant was not entitled to appeal and obligated him to pay fees and expenses, noting that the law requires the registrati­on of the appeal to be preceded by the payment of fees. It added that the complainan­t paid the fee ater the one-month period specified for appealing the primary verdict, and therefore he did not consider the legally decided dates for appeal.

On the other hand, The Central Bank of the UAE imposed administra­tive sanctions on the owner and general manager of an exchange house operating in the UAE, pursuant to Articles 87 and 137 of the Decretal Federal Law No. (14) of 2018 regarding the Central Bank and Organisati­on of Financial Institutio­ns and Activities.
